Terms and Conditions

of Etabl s.r.o. for the website www.martinaocadlikova.cz

1. Introductory Provisions

1.1. Tyto všeobecné obchodní podmínky (dále jen „VOP“) upravují práva a povinnosti smluvních stran smlouvy o poskytování služeb (dále jen „Smlouva“), kde na jedné straně vystupuje společnost Etabl s.r.o., se sídlem Rybná 716/24, Staré Město, 110 00 Praha, IČ: 04443586, DIČ: CZ04443586, zapsaná v obchodním rejstříku vedeném Městským soudem v Praze, oddíl C, vložka 247563 (dále jen „Poskytovatel“), a na straně druhé fyzická nebo právnická osoba (dále jen „Klient“), která si u Poskytovatele objednává služby koučování, mentoringu, konzultací či digitálních produktů (dále jen „Služby“).

These GTC are an integral part of every Agreement concluded between the Provider and the Client and are available on the website www.martinaocadlikova.cz.

Subject of the Agreement and Service Provision

2.1. The subject of the Agreement is the Provider's commitment to provide the Client with services in the field of coaching, mentoring, consultations, and digital products, and the Client's commitment to pay the agreed price for these service

2.2. The Provider undertakes to provide the services within the agreed scope, quality, and deadline.

2.3. The Client acknowledges that coaching services are not psychotherapy, healthcare, or psychological counseling. Coaching is focused on personal development and does not replace medical or therapeutic care.

2.4. The services are provided in person, online, or in the form of digital products (e.g., online courses, e-books), as specified in the order.

3. Order and Conclusion of the Agreement

3.1. The order can be placed via the web interface at www.martinaocadlikova.cz, by email, or by phone. www.martinaocadlikova.cz, e-mailem nebo telefonicky.

3.2. The Agreement between the Provider and the Client is formed at the moment the Provider accepts the order and confirms it by email.

3.3. The Provider reserves the right to refuse an order if the Client does not meet the service conditions or if there are reasons to believe that the service will not be used in accordance with its purpose.

4. Price and Payment Terms

4.1. The prices of services listed on the website www.martinaocadlikova.cz are inclusive of VAT.

4.2. The Client undertakes to pay the service price before its provision unless otherwise agreed. Payment is possible by:

• Bank transfer,
• Online card payment via the GoPay payment gateway.

4.3. An invoice for the service will be sent to the Client electronically to the email address specified in the order.

5. Cancellation Policy and Withdrawal from the Agreement

5.1. The Client has the right to withdraw from the Agreement within 14 daysif the service has not been provided.

5.2. Individual consultations can be canceled no later than 48 hours before the scheduled time. If the Client does not cancel in time, the consultation fee is forfeited and will not be refunded.

5.3. For online courses and digital products, withdrawal from the Agreement is not possible after access has been granted.

6. Complaints

6.1. The Client may file a complaint within 14 daysif the services were not provided in the agreed quality.

6.2. Complaints must be submitted in writing to the email coach@martinaocadlikova.cz.

7. Personal Data Protection (GDPR)

7.1. The Provider processes the Client's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll.

7.2. The Client agrees to the processing of personal data for service provision and marketing communication purposes.

8. Ethical Principles of Coaching

8.1. The Provider adheres to ethical coaching principles, particularly:

• Confidentiality of information shared during consultations,
• Respect for the Client's individual values and goals,
• Transparency and honesty in service provision,
• Ensuring a safe environment for the Client's personal development.

8.2. The Client undertakes to cooperate constructively and adhere to the principles of mutual respect during consultations.

9. Copyright and Content Protection

9.1. All content published on the website www.martinaocadlikova.czincluding texts, videos, online courses, e-books, webinars, and other digital products, is the intellectual property of Etabl s.r.o. and is protected by copyright law under Act No. 121/2000 Coll., Copyright Act.

9.2. Without prior written consent from the Provider, it is not permitted to:

• Copy, distribute, modify, make accessible to third parties, or otherwise use website content for commercial purposes,
• Use the content for one's business or educational activities that may compete directly with the Provider.

9.3. In case of a breach of these conditions, the Provider reserves the right to demand the immediate removal of unauthorized use of the content and claim compensation for damages resulting from the unauthorized use of intellectual property.

10. User Account Registration

10.1. To access certain services and products provided on the website www.martinaocadlikova.cz the Client may register and create a user account. By registering, the Client agrees to these terms.

10.2. The Client is required to provide truthful and current data. In case of any changes, the Client must update them immediately..

10.3. The Client is responsible for protecting login credentials to their user account. Sharing login credentials with third parties is not allowed. The Provider is not responsible for damages caused by misuse of the user account.

10.4. The Provider reserves the right to cancel or suspend the Client's accountat any time if there is a violation of these terms or suspected fraudulent or unethical behavior..

10.5. The Client has the right to request the deletion of their user account at any time by sending an email request to admin@martinaocadlikova.cz. The Provider will delete the account within 7 working days of receiving the request.

11. Final Provisions

11.1. These General Terms and Conditions come into effect on 3. 3. 2025.

11.2. The Provider reserves the right to unilaterally change and update these GTCwith the updated version always published on the website www.martinaocadlikova.czClients will be informed about changes at least 7 days before the new version takes effect. If the Client disagrees with the change, they have the right to request the deletion of their user account.

11.3. All disputes between the Provider and the Client will be resolved primarily amicablyIf an agreement cannot be reached, the competent court for dispute resolution is the relevant court in Prague.

11.4. If any provision of these GTC is invalid or ineffective, it does not affect the validity of the remaining provisions, which remain in force. The invalid or ineffective provision will be replaced by a provision that most closely corresponds to the meaning of the invalid provision.
