Terms and Conditions

These General Terms and Conditions (hereinafter referred to as the „GTC”) govern the rights and obligations of the contracting parties to a service provision agreement (hereinafter referred to as the „Agreement”), where on one side is Etabl s.r.o., with its registered office at Rybná 716/24, Staré Město, 110 00 Prague, business identification number: 04443586, tax identification number: CZ04443586, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 247563 (hereinafter referred to as the „Provider”), and on the other side is a natural or legal person (hereinafter referred to as the „Client”) who orders coaching, mentoring, consulting, or digital product services (hereinafter referred to as the „Services”) from the Provider.

These GTC are an integral part of every Agreement concluded between the Provider and the Client and are available on the website www.martinaocadlikova.cz.

The subject of the Agreement is the Provider's undertaking to provide the Client with services in the areas of coaching, mentoring, consulting, and digital products, and the Client's undertaking to pay the agreed price for these services.

The provider undertakes to provide services to the agreed extent, quality, and timeframe.

The client acknowledges that coaching services are not psychotherapy, healthcare, or psychological counselling. Coaching is focused on personal development and does not replace medical or therapeutic care.

Services are provided in person, online, or in the form of digital products (e.g., online courses, e-books), as specified in the order.

Orders can be placed via the web interface at www.martinaocadlikova.cz, by email, or by telephone.

The contract between the Provider and the Client is formed at the moment the order is accepted by the Provider and confirmed by e-mail.

The provider reserves the right to refuse an order if the Client does not meet the terms of service or if there are reasons to believe that the service will not be used in accordance with its purpose.

The prices of services are listed on the website www.martinaocadlikova.cz and include VAT.

The client undertakes to pay for the service before its provision, unless otherwise agreed. Payment is possible:

• By bank transfer
• Online payment by card via the GoPay payment gateway

The invoice for the service will be sent to the Client electronically to the e-mail address provided in the order.

The client has the right to withdraw from the contract within 14 days if the service has not been provided.

For individual consultations, appointments can be cancelled no later than 48 hours before the scheduled time. If the Client does not cancel the appointment in time, the amount for the consultation will be forfeited and will not be refunded.

For online courses and digital products, the right of withdrawal from the contract cannot be exercised once they have been made available.

The customer can make a complaint within 14 days if the services were not provided to the agreed quality.

Complaints must be submitted in writing by email coach@martinaocadlikova.cz.

The Provider processes the Client's personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll.

The client agrees to the processing of personal data for the purposes of providing services and marketing communications.

The provider adheres to the ethical principles of coaching, particularly:

• Confidentiality of information shared during consultations
• Respect for the client's individual values and goals
• Transparency and honesty in service provision
• Ensuring a safe environment for the Client's personal development

The client undertakes to cooperate constructively and to adhere to the principles of mutual respect during consultations.

All content published on the website www.martinaocadlikova.cz, including texts, videos, online courses, e-books, webinars, and other digital products, is the intellectual property of Etabl s.r.o. and is protected by copyright under Act No. 121/2000 Coll., the Copyright Act.

Without prior written consent from the Provider, it is not permitted to:

• Copy, distribute, modify, make accessible to third parties, or otherwise use website content for commercial purposes,
• Use the content for one's business or educational activities that may compete directly with the Provider.

In the event of a breach of these terms, the Provider reserves the right to demand immediate removal of unauthorisedly used content and to claim damages incurred by the unauthorised use of intellectual property.

For the use of certain services and products provided on the website www.martinaocadlikova.cz, the client may register and create a user account. By registering a user account, the client agrees to these terms and conditions.

The client is obliged to provide true and up-to-date details upon registration. In the event of a change in details, the client is obliged to update them immediately.

The client is responsible for protecting their user account access details. It is not permissible to share login details with third parties. The provider is not liable for damages caused by the misuse of the user account.

The provider reserves the right to cancel or suspend a client's account at any time in the event of a breach of these terms and conditions or if fraudulent or unethical behaviour is suspected.

The client has the right to request the cancellation of their user account at any time by sending an email request to admin@martinaocadlikova.cz. The provider will cancel the account within 7 working days of receiving the request.

These General Terms and Conditions come into effect on 3 March 2025.

The provider reserves the right to unilaterally amend and update these General Terms and Conditions, with the updated version always being published on the website www.martinaocadlikova.cz. The client will be informed of any changes at least 7 days before the new version comes into effect. If the client does not agree with the changes, they have the right to request the cancellation of their user account.

All disputes between the Provider and the Client shall be settled amicably in the first instance. If no agreement is reached, the competent court for dispute resolution shall be the court with subject-matter and local jurisdiction in Prague.

If any provision of these General Terms and Conditions is invalid or ineffective, this shall not affect the validity of the remaining provisions, which shall remain in force. The invalid or ineffective provision shall be replaced by a provision whose meaning is as close as possible to the invalid provision.
